Clear, professional terms for working with Ignite Web Design
These Terms of Service ("Terms") outline the rules and expectations when working with Ignite Web Design ("we," "us," or "our"). By hiring us or using our services, you agree to these terms. If anything is unclear, just ask — we're happy to clarify.
0. Agreements Take Priority
If you've signed a separate service agreement, proposal, or contract with us, the terms in that document take priority over anything listed here. These Terms of Service apply to general use of our website and services unless otherwise specified in writing.
1. Services
We provide web design, development, SEO, digital marketing, and related services. Your specific scope of work will be outlined in your proposal or agreement before we begin.
Revisions
Each project includes a set number of revisions, noted in your agreement. If you need more, we'll always let you know the cost ahead of time.
Timelines
We'll give you realistic timelines and do our best to meet them. Delays can happen if content, feedback, or approvals are delayed on your end.
2. Payments
Deposits & Invoicing
Most projects require a deposit upfront. Final payment is due upon completion or at set milestones as outlined in your agreement.
Late Payments
Invoices not paid within 30 days may be subject to late fees or a pause in work. We'll always communicate with you first if there's an issue.
3. Client Responsibilities
You agree to:
- Provide timely content, feedback, and approvals
- Ensure you have rights to use any materials (images, logos, text) you give us
- Let us know if anything changes that might affect the project
4. Intellectual Property
What You Own
Once the project is paid in full, you own the final website and deliverables. This includes the design, graphics, and written content we created specifically for your business.
What We Own
We retain the right to showcase the work in our portfolio, unless you ask us not to in writing. Any tools, templates, or software we use to build your site remain our intellectual property.
5. Cancellations & Refunds
You can cancel a project at any time. If work has already started, you may be responsible for a portion of the project cost based on work completed. Deposits are usually non-refundable.
6. Warranties & Disclaimers
We take pride in our work, but we can't guarantee:
- Top search engine rankings
- Compatibility with every outdated browser or device
- Continuous uptime if we're not managing your hosting
We'll always do our best to catch issues and keep you informed.
7. Limitation of Liability
We're not liable for any direct or indirect damages, lost revenue, or data loss arising from:
- Third-party tools or integrations
- Changes you make to the website after launch
- Hosting issues or downtime beyond our control
8. Ongoing Services
For things like hosting, SEO, maintenance, or marketing retainers, a separate agreement may apply. You or we can cancel these ongoing services with 30 days' written notice unless otherwise agreed.
9. Changes to These Terms
We may update these Terms occasionally. When we do, we'll update the date at the top. You can always find the latest version on our website.
11. Google Business Profile Review Integration
The following terms apply to your use of the Google Business Profile Review Integration module within Ignite CRM (the "Review Module"). By enabling or using the Review Module, you agree to these terms in addition to all other Terms of Service and any executed service agreement between you and Ignite Web Design.
11.1 Description of Service
The Review Module is an integrated feature of Ignite CRM that allows you to authenticate via Google OAuth, retrieve Google Business Profile customer reviews, and publish replies to those reviews from within your CRM dashboard. The Review Module is provided as part of Ignite CRM's existing multi-tenant infrastructure and is not offered as a standalone product.
11.2 Mandatory Compliance with Google Terms and Policies
You agree to comply strictly and at all times with:
- The Google Maps/Google Earth Additional Terms of Service;
- All applicable Google Business Profile policies and guidelines, including the Google Business Profile Engagement Policies;
- The Google API Services User Data Policy, including Limited Use requirements, to the extent applicable to your use of Google-connected features;
- All other Google terms, policies, and program requirements applicable to Google Business Profile and related APIs.
You acknowledge that Google—not Ignite Web Design—owns and operates Google Business Profile, and that Google may change, suspend, or terminate API access or profile features at any time without notice to Ignite Web Design.
11.3 Authorized Use Only
You represent and warrant that:
- You have lawful authority to connect the Google account and Google Business Profile location(s) you link to Ignite CRM
- You are connecting only locations you own or are explicitly authorized to manage on behalf of the business
- All review replies you publish through the Review Module are truthful, professional, and submitted on behalf of the applicable business
- Your use of the Review Module complies with all applicable laws, including consumer protection and anti-spam laws
11.4 Prohibition of Review Manipulation and Prohibited Conduct
You agree that you will not use Ignite CRM, including the Review Module, to engage in any of the following:
Fake or fraudulent reviews
- Creating, soliciting, purchasing, posting, or directing the posting of fake, misleading, or inauthentic reviews on Google Business Profile or any other platform
- Impersonating customers or third parties in review replies
Automated abuse and spam
- Using bots, scripts, macros, or bulk-automation tools to post review replies in a manner that violates Google policies or applicable law
- Flooding review threads with repetitive, irrelevant, or promotional spam content
Incentivized review schemes
- Offering compensation, discounts, gifts, sweepstakes entries, or other incentives in exchange for reviews (positive or negative)
- Conditioning benefits on the content or star rating of a review
Review gating
- Selectively soliciting reviews only from customers likely to leave positive feedback
- Suppressing, filtering, or discouraging negative feedback before it reaches Google or any public review platform
- Using CRM workflows, surveys, or communications to route dissatisfied customers away from public review channels while directing satisfied customers to leave Google reviews
API and quota abuse
- Attempting to circumvent API rate limits, quotas, or technical restrictions
- Reverse engineering, scraping, or accessing Google services outside the authorized OAuth integration provided by Ignite CRM
- Sharing OAuth credentials or CRM access in a manner that enables unauthorized third parties to access Google Business Profile data
Misuse of Google user data
- Exporting, reselling, sublicensing, or transferring Google-sourced review data to third-party ad networks, data brokers, or external AI systems
- Using Google-sourced data for advertising profiling or unrelated commercial purposes
Any violation of this Section constitutes a material breach of these Terms.
11.5 API Access, Quotas, and Service Limitations
You acknowledge that Ignite CRM accesses Google Business Profile data through a Google Cloud API project operated by Ignite Web Design. API availability, rate limits, and functionality are subject to Google's control.
Ignite Web Design does not guarantee uninterrupted access to Google APIs and is not responsible for outages, policy enforcement actions, or feature changes initiated by Google.
11.6 Immediate Suspension and Termination Rights
Ignite Web Design reserves the right, in its sole discretion and without prior notice, to immediately suspend or permanently revoke your access to the Review Module—and, where necessary, your broader Ignite CRM account—if:
- We reasonably believe you have violated any Google terms, policies, or API requirements
- Your conduct places Ignite Web Design's Google Cloud API project, OAuth verification status, or production API access at risk of suspension, restriction, or revocation
- You engage in review manipulation, spam, gating, or other prohibited conduct described in Section 11.4
- Google requests that we restrict or terminate your access
- We are required to do so by law or by Google's enforcement action
Suspension or termination under this Section does not entitle you to a refund of fees paid for other Ignite CRM services unless expressly stated in a separate written agreement. Ignite Web Design may report prohibited conduct to Google or relevant authorities where appropriate.
11.7 Indemnification
You agree to indemnify, defend, and hold harmless Ignite Web Design, its officers, directors, employees, and agents from any claims, damages, fines, penalties, losses, and expenses (including reasonable legal fees) arising from: your violation of Google terms or policies; your unauthorized connection of Google accounts or Business Profile locations; review manipulation, spam, gating, or other prohibited conduct; or any review reply content you publish through the Review Module.
11.8 Disconnection
You may disconnect the Review Module at any time through your CRM settings. Upon disconnection, Ignite Web Design will cease making Google API calls on your behalf and will handle stored Google-related data in accordance with our Privacy Policy.
